Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the RoomStaged website, products and services (the “Service”). Please read them carefully. By using the Service, you agree to these Terms.

Who you are contracting with The Service is operated by Outliers Lab LLC, a Wyoming limited liability company (“RoomStaged,” “we,” “us,” or “our”), located at 30 N Gould St Ste N, Sheridan, WY 82801, United States. You can reach us at [email protected].

1.The Service

RoomStaged provides done-for-you photo enhancement for real-estate listings, including virtual staging of empty rooms, sky replacement and twilight conversions, decluttering, and related image edits. Each delivered image is reviewed by a human before it reaches you. We deliver finished images to you, typically over WhatsApp, generally within 24 hours of receiving usable source photos. We may change, improve, or discontinue features of the Service at any time.

2.Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a brokerage, team, or other organization, you represent that you are authorized to bind that organization to these Terms.

3.Your photos and the license you grant us

You retain ownership of the photographs and materials you submit (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, process, and edit Your Content solely to provide the Service to you. When we deliver an edited image to you, you own that delivered image and may use it for your listing, subject to your payment and these Terms. We may retain anonymized or de-identified versions of images to operate and improve the Service.

You represent and warrant that you own or have all necessary rights to Your Content, and that our processing of it will not infringe the rights of any third party.

4.Disclosure and non-misrepresentation

RoomStaged produces edited and digitally enhanced images. Virtual staging, sky replacement, twilight conversion, and decluttering alter the depiction of a property. You are solely responsible for using delivered images in a manner that is truthful and compliant with all applicable laws, MLS rules, and the professional standards that apply to you (including, where applicable, the National Association of REALTORS® Code of Ethics and your local MLS’s image and disclosure policies).

You agree to clearly disclose that images have been virtually staged or digitally enhanced wherever such disclosure is required, and to follow any labeling rules of the MLS or platform on which you publish.
You agree not to use the Service to misrepresent the physical condition, features, size, or fixtures of a property, to remove or conceal material defects, or to create a deceptive impression of a property.
To support compliant use, delivered images may include a visible or embedded indication that they are virtually staged or enhanced; you agree not to remove such indications where disclosure is required.

You are responsible for the final listing and how delivered images are presented and disclosed. This responsibility rests with you, not with RoomStaged.

5.Acceptable use

You agree not to use the Service to: submit content you do not have the right to use; depict properties you are not authorized to market; create content that is unlawful, fraudulent, defamatory, or infringing; or attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.

6.Pricing, payment, and refunds

Pricing is shown on our site and may include promotional offers such as a first free photo. Paid edits are billed per image or per the plan you select, through our third-party payment processor. Because the Service is a custom digital service produced on demand, fees are generally non-refundable once work has been delivered; if a delivered image does not meet the scope you ordered, contact us at [email protected] and we will work in good faith to revise it or make it right.

7.No guarantee of outcomes

We strive for fast, high-quality results, but we do not guarantee any particular turnaround in every case, nor any sales, leads, showings, or listing outcomes. The Service is provided to help you present a listing; results depend on many factors outside our control.

8.Intellectual property

The Service, including our software, site, branding, and the “RoomStaged” name, is owned by Outliers Lab LLC and protected by applicable laws. These Terms do not grant you any rights in our intellectual property except the limited right to use delivered images as described above.

9.Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

10.Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUTLIERS LAB LLC AND ITS OWNERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11.Indemnification

You agree to indemnify and hold harmless Outliers Lab LLC from any claims, damages, or expenses arising out of Your Content, your use of delivered images, your listings, or your breach of these Terms, including any claim that a delivered image was used in a way that was misleading or non-compliant with applicable disclosure rules.

12.Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk or legal exposure for us or others.

13.Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14.Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. The exclusive venue for any dispute that is not subject to arbitration or small-claims resolution will be the state or federal courts located in Wyoming, and you consent to their jurisdiction.
